Terms of Use of the MojaDružina service
Last updated: 4 September 2026
1. Provider and scope
These Terms of Use (hereinafter: the “Terms”) govern registration for and use of the MojaDružina website and application on the mojadruzina.si domain (hereinafter: the “Service”).
The provider of the Service is DATAFLOW, informacijske in podatkovne rešitve, d. o. o., Krpanova ulica 3, 6310 Izola – Isola, Slovenia, registration number: 7447035000, tax number: 61888630 (hereinafter: the “Provider”, “DATAFLOW” or “we”). Contact: info@mojadruzina.si.
These Terms apply exclusively to the MojaDružina Service and not to ARSI services or other services of DATAFLOW, which are subject to separate terms.
2. Conclusion of the contract and acceptance of the Terms
The contract for use of the Service is concluded when the user completes registration and confirms that they agree to the Terms. Before registering, the user has access to the Terms and the Privacy Policy. Before confirming, the user can check and correct the data entered. The Terms are published in a form that allows them to be displayed, stored and reproduced.
The contract may be concluded in the languages available in the registration process. The current version of the Terms is available to the user on the website. A user who does not agree to the Terms must not create an account or must stop using the Service.
3. Description of the Service
MojaDružina is a private web application that allows users to create and complete a family tree, store photos, stories and memories, collaborate with invited family members, follow family moments and use other available features.
Family content is not published and is accessible only to users invited to the individual family, in line with the rights assigned. Individual features may be marked as experimental, upcoming or not yet available.
4. Registration, age and account
Registration is intended for natural persons of legal age. The user must provide a valid e-mail address and the data needed for the account to work. The user must not impersonate another person or create an account for someone without their permission.
The user must protect their password and access to the linked e-mail account. The account must not be transferred to another person. The user must notify us as soon as possible at info@mojadruzina.si of any suspected misuse, loss of access or unauthorised use.
5. Families, invitations and collaboration
A user may create a family or join a family by invitation. An invitation may only be sent to a person who, in the user’s reasonable opinion, wishes to receive it. The contact details of invited persons must not be used for advertising or other unrelated purposes.
Members of the same family may, depending on the rights available, view, add or change shared data. The user understands that their content may be visible to other invited members and that they may contribute additional data. Users should first try to resolve any disputes between family members amicably.
6. Permitted use
The Service may be used for personal and lawful family purposes. In particular, it is prohibited to:
- publish unlawful, threatening, offensive, discriminatory or misleading content;
- interfere with the privacy, personality rights, copyright or other rights of third parties;
- enter particularly sensitive data about living persons without their explicit consent or another appropriate legal basis;
- send unsolicited invitations, advertisements or automated messages;
- attempt to access accounts or families without permission;
- circumvent security measures, spread malicious software, overload the Service or use it for automated mass data collection;
- use the Service in a way that harms other users, the Provider or the operation of the system.
7. Data and content about other persons
The user is responsible for having an appropriate right or legal basis to enter names, photos, dates, life stories and other data about living persons. Where necessary, the user must inform these persons that their data has been entered and is shared privately.
Photos and data of minors may only be entered by a parent, guardian or other duly authorised person acting in the child’s best interest. For data about deceased persons, the user must respect the wishes of the deceased, the rights of relatives, the confidentiality of communications and applicable law.
If a person requests the removal of data relating to them, we will handle the request in accordance with the Privacy Policy and applicable law.
8. Rights to user content
The user, or the original rights holder, retains copyright and other rights to the content they enter. By entering content, the user grants the Provider, for as long as the content is stored, a non-exclusive, free licence, necessary to provide the Service, to technically store, back up, convert, display and make the content available to authorised members of the same family.
This licence is not intended for advertising, public disclosure or sale of user content. Termination of the account ends the licence once the content has been deleted from the active system and backups, except for shared family content that legitimately remains accessible to other members.
9. Intellectual property of the Service
The software, design, trademarks and graphic marks, texts and other elements of the Service not contributed by users are the property of the Provider or its licensors. The user obtains a limited, non-transferable and revocable right to use the Service in accordance with these Terms. Copying, selling, renting, reverse engineering or other unauthorised use of the Service is not permitted.
10. Free use and paid services
Registration and use are currently free. The current free use is not a time-limited trial period, and by registering the user does not assume any obligation of future payment.
In the future, the Provider may introduce additional paid packages or features. No paid service, subscription or automatic renewal will be activated without the user’s prior clear choice and explicit confirmation of the price and terms. Before any purchase, the user will be given all information required by law. A user who does not choose a paid option will not be charged merely because they registered.
Family book (PDF). The owner or administrator of a family can create a family book from the family’s data. Without a purchase, the book is available as a preview with a “PREVIEW” watermark. A purchase unlocks the book for the chosen family: during the period stated at the time of purchase, the user can complete, edit and download or print it without the watermark as often as they wish.
Price and payment. The price is clearly stated in euros at the time of purchase and includes VAT. It is a one-off payment with no subscription or automatic renewal. Payment is processed by the payment service provider Stripe; the Provider does not receive or store payment card details. The purchase contract is concluded when the payment is confirmed. The buyer receives by e-mail a purchase confirmation, which also contains confirmation of the consent described in the next paragraph, as well as a payment receipt or invoice.
Delivery and right of withdrawal. The unlock takes place automatically immediately after the payment is confirmed. For distance contracts, consumers generally have a right of withdrawal within 14 days. As this is digital content not supplied on a tangible medium, before payment the buyer expressly consents to performance beginning immediately and acknowledges that they thereby lose the right of withdrawal. This does not affect the buyer’s rights in the event of a lack of conformity of the digital content.
Problems with unlocking. If the unlock does not take place because of a technical error, the buyer should notify us at info@mojadruzina.si. We will fix the error without delay or refund the price.
Duration and changes. The unlock applies to the family for which it was purchased and for the period stated at the time of purchase. A new purchase extends an existing unlock. If the account or family is deleted before the period ends, the price is not refunded unless the deletion is caused by the Provider or the law provides otherwise. The Provider may change the price and offer for future purchases; unlocks already paid for remain unchanged.
11. Operation, maintenance and updates
We strive to ensure safe and reliable operation, but temporary interruptions may occur due to maintenance, updates, security incidents, outages of external providers or force majeure. Where reasonably possible, we will announce longer planned interruptions in advance.
We will maintain the Service and provide the necessary security updates in accordance with applicable law. We may improve, change or replace features, provided this does not disproportionately affect users’ essential rights. We will inform users of significant changes.
12. Export, deletion and termination of the account
The user may stop using the Service and request deletion of their account. Before deletion, they should use the available export of photos and notes as a ZIP file and of the family tree in GEDCOM format.
Deleting an individual account does not necessarily mean deleting shared family content that other members have also created, completed or legitimately use. On request, we will explain the consequences of deletion and act in accordance with the Privacy Policy. Data is deleted from the active system within the time limits stated there.
13. Restriction or termination of access
We may temporarily restrict access because of a security risk, a well-founded suspicion of misuse, urgent maintenance or a breach of the Terms. Where possible and appropriate, we will warn the user before taking action and allow them to remedy the breach.
In the event of a serious or repeated breach, a threat to security, interference with the rights of others or use of the Service for unlawful purposes, we may close the account. The measure must be proportionate to the nature of the breach. Where the law and security allow, we will enable the user to export their data.
14. Conformity of the digital service and liability
Users have the rights granted to them by mandatory consumer protection and digital services legislation. If the Service does not work in line with the agreed and legally required characteristics, the user may notify us and request that the lack of conformity be remedied appropriately.
The Provider is not liable for problems arising from the user’s device, internet connection, improper use, loss of credentials or the conduct of other invited members, except where liability cannot be excluded by law. Nor is the Provider liable for user content, but it may take action upon receiving a substantiated notice of unlawful or disputed content.
Nothing in these Terms excludes liability for intent, gross negligence, damage caused by breach of mandatory consumer protection rules or any other liability that cannot be limited by law.
15. Privacy
The processing of personal data, retention periods, processors, cookies and the rights of individuals are described in detail in the Privacy Policy, which is a separate information document and an integral part of transparent information for users.
16. Changes to the Terms
We may change the Terms because of the development of the Service, security, changes to the offer or to legislation. We will inform users of material changes in the application or by e-mail within a reasonable period before they take effect.
If a change significantly and adversely affects the use of the Service, the user may stop using the Service and request deletion of their account before the change takes effect. A change cannot automatically enrol the user in a paid service.
17. Complaints
Questions, error reports and complaints may be sent to info@mojadruzina.si. We will confirm receipt of a complaint and, as a rule, respond within 15 days. If more time is needed to respond, we will inform the user.
18. Out-of-court resolution of consumer disputes
In accordance with applicable law, DATAFLOW, informacijske in podatkovne rešitve, d. o. o. does not recognise any out-of-court consumer dispute resolution provider as competent to resolve a consumer dispute. This does not affect the consumer’s right to judicial protection, to report to the competent authority or to use other legal remedies.
19. Governing law and jurisdiction
These Terms and the use of the Service are governed by the law of the Republic of Slovenia. If the user is a consumer, this provision does not limit the protection afforded to them by the mandatory rules of the country of their habitual residence. Disputes fall under the jurisdiction of the court determined in accordance with the applicable rules on subject-matter and territorial jurisdiction.
20. Final provisions and contact
If any individual provision is invalid or unenforceable, this does not affect the validity of the remaining provisions. The invalid provision is replaced by a valid rule that comes closest to its purpose and does not reduce the user’s statutory rights. This text is a translation of the Slovenian version; in case of any discrepancy, the Slovenian version prevails.
